Why would a neighbor's rebuild flood this house?
Because the water has to go somewhere. A house two or three times the size, with a bigger drive and patio, sheds far more than the one it replaced, and the lot it sits on has much less open ground to absorb it. The surplus crosses the line.
Was the drainage supposed to account for that?
It generally is, through detention or storage on the rebuilt lot, and the question is whether what was approved was actually built and is still working. A buried storage system that has silted up performs exactly like one that was never installed.
How is a case like that made?
With records rather than impressions. Photographs of the yard before and after the neighboring build, dated notes of when water first appeared, and the approved drainage drawings from the village between them make the argument. Recollection on its own does not.
